This Site is operated by HexClad Cookware Trading LLC, a company incorporated in the United Arab Emirates and operating the HexClad brand in the UAE (we, us or our).

2. BY USING THIS SITE YOU ACCEPT THESE TERMS

By accessing or using the Site, you confirm that you have read, understood and agree to comply these Terms and that you agree to comply with these Terms. If you do not agree with any part of these Terms, then you must not use the Site.

Your purchase of any products through the Site will be governed by our Terms and Conditions of Sale, which are separate from these Terms.

We recommend that you retain a copy of these Terms for your records.

6. PRODUCTS

Images and other depictions of products on the Site are for illustrative purposes only. Although we use reasonable efforts to display the colours, features and details of products accurately, the appearance of products may vary from how they appear on your device or from their packaging.

Product information made available on the Site is provided for general information only and does not form part of any contract for the sale of goods. Any purchase of products through the Site is governed by our Terms and Conditions of Sale.

7. YOUR ACCOUNT INFORMATION

If you choose, or you are provided with, a user identification code, password or any other account-related information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

We may disable any user identification code or password, whether chosen by you or allocated by us, if we reasonably believe that you have failed to comply with any of these Terms. If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at uaesupport@hexclad.com.

Suspension or closure of a Site account does not affect any rights or obligations relating to purchases made through the Site, which are governed by our Terms and Conditions of Sale.

8. WHAT YOU MAY NOT DO ON THE SITE

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except where specifically endorsed or approved by us. For further information on permitted use of the Site and prohibited activities please refer to our Acceptable Use Policy https://hexclad.ae/pages/acceptable-use-policy (as may be updated from time to time). Engaging in any prohibited activities may result in account suspension or termination of access to the Site. Preventing access to the Site does not affect any rights or obligations relating to purchases made through the Site, which are governed separately by our Terms and Conditions of Sale.

We reserve the right to enforce our rights in connection with misuse of the Site.

9. UPLOADING YOUR CONTENT TO THE SITE INCLUDING REVIEWS

We may allow you to create, submit, post, display, transmit, publish, distribute or otherwise make available content and materials on the Site, including text, images, audio, video, graphics, comments, reviews, ideas, feedback or other material (Contributions). You are solely responsible for any Contributions you upload and for securing and backing up your content.

Contributions may be visible to other users of the Site and to users of third-party websites. When you make any Contributions, you must comply with the content standards set out in our Acceptable Use Policy.

Any Contributions you make to the Site will be treated as non-confidential and non-proprietary, other than personal data which will be handled in accordance with our Privacy Policy and your choices (including privacy and account settings). You must not establish a link to the Site on a website that does not comply with our Acceptable Use Policy. The Site must not be framed on any other site.

11. SITE MANAGEMENT

We reserve the right, but not the obligation, to: (1) monitor the Site for violations of these Terms; (2) enforce our rights or cooperate with law enforcement authorities in connection with any conduct that may violate the law or these Terms; (3) refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof; (4) remove from the Site or otherwise disable files and content that are excessive in size or are in any way burdensome to our systems; and (5) otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site and the products made available through it.

Any restriction or suspension of access to the Site under this Section does not affect any rights or obligations relating to purchases made through the Site, which are governed separately by our Terms and Conditions of Sale.

12. HOW WE USE YOUR PERSONAL INFORMATION

13. OPERATION OF THE SITE AND TERMINATION

These Terms remain in effect while you access or use the Site. We may do any of the following, where reasonably necessary and with or without prior notice:

(i) modify, suspend or terminate operation of, or your access to, the Site or any portion of it, including where we reasonably believe you have violated these Terms;

(ii) modify or change the Site or any portion of it; or

(iii) interrupt the regular operation of the Site to perform routine or non-routine maintenance, correct errors, or implement changes relating to technical systems, functionality, user volumes or service improvements.

If we suspend or terminate your account, you must not register or create a new account using your name, a false identity, or the identity of any other person. We may enforce our rights or cooperate with law enforcement authorities in connection with misuse of the Site.

14. OUR RESPONSIBILITY TO YOU IF YOU SUFFER LOSS OR DAMAGE

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence and for fraud or fraudulent misrepresentation.

We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable.

Different limitations and exclusions of liability apply to liability arising from the supply of products to you, which are governed by our Terms and Conditions of Sale.

The Site is provided for domestic and private use only. You agree not to use the Site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

15. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and any dispute or claim arising out of or in connection with them (including any non-contractual dispute or claim) are governed by the federal laws of the United Arab Emirates and the laws of the Emirate of Dubai. The courts of Dubai, United Arab Emirates, shall have exclusive jurisdiction to settle any such dispute or claim.

If a dispute arises between you and us in connection with these Terms or your use of the Site, we encourage you to contact us first so that we may attempt to resolve the matter amicably. Nothing in this Section prevents either you or us from bringing proceedings before the competent courts of Dubai at any time.
